Terms of Service

These terms govern your use of LumiHQ — client galleries, print sales and studio management software for photographers. By creating an account or using the service you agree to them.

The service

LumiHQ lets photographers host client galleries, sell prints and digital downloads, and manage their studio (bookings, contracts, invoices, questionnaires and client communication). We’re in active development: features may be added, changed or retired, and we’ll communicate material changes to anything you rely on.

Your account

• You must provide accurate account information and keep your login credentials secure. You’re responsible for activity under your account.
• You must be at least 18 and using LumiHQ for a photography business or practice.
• We may suspend or terminate accounts that breach these terms, after notice where practical.

Your content

• You keep your rights. Photos and content you upload remain yours (and, where applicable, your clients’). You grant us only the licence needed to host, process, display and deliver them as the service requires — resizing, watermarking, generating downloads, fulfilling print orders.
• You’re responsible for having the rights and any consents needed for the content you upload and the client information you store, and for your own obligations to your clients under privacy law.
• Don’t upload unlawful content or use the service to send spam. We may remove content or suspend service where we reasonably believe the law or these terms require it.

Plans, billing and cancellation

• Signing up is free. Paid plans are billed in advance in AUD (monthly or yearly) through Stripe, at the prices shown at checkout.
• You can cancel any time from your dashboard; paid features remain active until the end of the period you’ve paid for. We don’t refund partial periods except where the law (including the Australian Consumer Law) requires it.
• If a subscription lapses, your account reverts to the free tier. Content over the free tier’s limits isn’t deleted immediately — we’ll give you a reasonable opportunity to export or resubscribe before removing anything.
• We may change plan pricing with reasonable advance notice, effective from your next billing period.

Print orders and client payments

• Print orders placed in your galleries are fulfilled by third-party labs. We pass orders on and track their status, but production and shipping timelines are the lab’s.
• Payments from your clients (print sales, invoices, deposits) are processed through your own connected payment account. That money flows to you and is your business — including your tax and consumer-law obligations to your clients.
• LumiHQ does not take a commission on your print sales or invoices. Payment processors and labs charge their own fees.

Availability and data

• We aim to keep the service available and your data safe — including encrypted backups — but no online service can promise uninterrupted availability.
• Keep your own copies of your original photos. LumiHQ is a delivery and business tool, not your archival backup.
• You can export your data (galleries, contacts, invoices) while your account is active.

Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law or other laws that cannot be excluded. Subject to that, the service is provided “as is”; to the extent permitted by law, our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose, and we’re not liable for indirect or consequential loss (such as lost profits or lost bookings).

General

• These terms are governed by the laws of Australia.
• We may update these terms; if a change is material we’ll notify account holders before it takes effect. Continuing to use the service after that means you accept the updated terms.
• If part of these terms is found unenforceable, the rest still applies.
